Mail Hosting Service Agreement

Purpose

This agreement aims to define the scope, usage conditions, and backup and data security processes of the mail hosting service provided by Atak Domain Information Technology Co. (hereinafter referred to as the "Service Provider"). The agreement is created to ensure secure and sustainable usage of email services by individual and corporate customers.

1. Scope of the Agreement

  • The Service Provider will provide the Customer with mail hosting services, including operating email accounts on servers, ensuring secure access, and basic maintenance services.
  • This agreement does not cover email backup services. The Customer is solely responsible for backing up their email data.

2. Service Usage Conditions

  • The mail hosting service can only be used for individual or corporate email communication purposes.
  • The following actions are strictly prohibited:
    • Sending spam, phishing, or bulk advertising emails.
    • Sending content that violates laws.
    • Engaging in malicious activities that could overload the server.
  • The Service Provider reserves the right to suspend the service or terminate the agreement in case of violations of these rules.

3. Service Duration and Suspension Rules

  • The service is activated from the date of payment and is valid for the specified duration.
  • In case of non-payment:
    • The service will be suspended, and access will be denied on the 0th day of the delay.
    • All data will be permanently deleted on the 30th day after the service suspension.
  • The Customer acknowledges that email content related to the deleted service cannot be recovered.

4. Backup and Data Security

  • The Service Provider does not perform regular backups for mail hosting services.
  • Email content on servers is accessible only in cases of legal obligations or official requests from government authorities.
  • In such cases, only the server backups for the relevant period can be provided.
  • The Service Provider is not liable for any data loss.

5. Responsibilities of the Service Provider

  • The Service Provider will provide all necessary technical and infrastructural support to ensure uninterrupted and continuous service.
  • The Service Provider is not responsible for short-term interruptions due to planned maintenance or unforeseen technical issues.
  • The Service Provider is not liable for damages caused by unauthorized access to the Customer's email accounts.

6. Responsibilities of the Customer

  • The Customer is responsible for keeping the usernames and passwords provided within the scope of the mail hosting service confidential.
  • The Customer agrees to use the service only within the specified conditions and not to perform any illegal activities.
  • The Customer is solely responsible for storing email content and data backups.

7. Termination and Cancellation of the Agreement

  • The Customer may terminate the agreement by providing written notice before the end of the service duration.
  • The Service Provider reserves the right to terminate the service if the Customer violates the terms outlined in this agreement.

  • This agreement is subject to the laws of the Republic of Turkey.
